Impending Tax Legislation and Athletic Seating Gifts

Thank you for your support of MSU Athletics as a Spartan Fund donor. Your investment in MSU Athletics enhances the experience for 800 Spartan student-athletes, providing them opportunities to pursue excellence in the classroom, competition, and the community.
This letter is to inform of proposed federal tax legislation that may impact you. As you may be aware, the U.S. House of Representatives and the U.S. Senate have passed versions of the Tax Cuts and Jobs Act. Differences between the House and Senate bills are being reconciled to produce one final bill for both chambers to vote on by the end of the calendar year.
Current tax rules provide up to an 80 percent charitable deduction for gifts associated with premium seating at athletic events. The proposed tax legislation eliminates this tax deduction. Donors interested in receiving this tax deduction are encouraged to make their contribution before the end of the year.

MSU Athletics will continue to monitor the proposed tax legislation closely. Early contributions for Spartan Fund renewals, including gifts towards seats, facilities, endowments, or other designations are always welcome and accepted. Gifts may be made in a variety of ways, including cash or marketable securities.

Check with your employer to determine if your donation to MSU Athletics is eligible for a matching gift! Matching gifts not only provide additional resources but can also serve as a vehicle for you to increase your donor priority! If your company will match gifts to MSU Athletics, please enclose your company’s form with your contribution.
PLEASE NOTE: Matching gifts may not be utilized to fulfill any seating requirements and/or be a part of a fulfillment to a pledge.
Wishing to leave a legacy with MSU Athletics while planning for the future? Gifts in the form of life income gifts (Charitable Remainder Trust, Charitable Gift Annuity), charitable lead trusts, and/or bequests are common ways to state your intentions of leaving a future gift to MSU Athletics – all while receiving substantial income, estate, and gift tax benefits now!

Donated services or items (food and beverage, athletic equipment, printing, and air travel, etc.) that would normally be purchased by the MSU Athletics Department are considered gifts-in-kind, and are always appreciated. Subject to university approval and IRS regulations, the value of the contribution is credited to your name.
Individuals who make a contribution to MSU Athletics will have their gift processed and tax receipt issued by Michigan State University.
DONOR ADVISED FUNDS & PRIVATE FOUNDATIONS
Federal law prohibits charitable distributions from either a donor advised fund or private foundation when goods or services that may be considered more than incidental, including premium seats, are obtained by the donor in exchange for the gift. Therefore, the Spartan Fund cannot accept seat-related gifts from either a donor advised fund or private foundations and will return such gift if received. IRA CHARITABLE ROLLOVER – Ages 70 1/2 or older
As of December 2015, donors aged 70 1/2 or older may move up to $100,000 from their IRAs directly to qualified charities without having to pay income tax on their gift.
